Infrastructure projects in Ukraine sit at the intersection of construction, public procurement, energy and finance law. Before mobilisation, five questions materially shape the legal profile of a project.
1. Which procurement route applies?
The route determines the tender rules, the permissible degree of design development and the room for negotiation — and it constrains the contract form available.
2. What permits are required, and when?
Permitting timelines rarely align with construction programmes. Sequencing works against regulatory milestones is a contractual question as much as a technical one.
3. What does the financing require?
International lenders and donors impose conditions on contract form, environmental and social standards, reporting and dispute resolution. These conditions are best mapped onto the contract before signature, not after.
4. How is risk allocated?
Security conditions, supply chain disruption, currency movement and change in law each need an explicit home in the contract. Silence is itself an allocation, usually an unfavourable one.
5. How will disputes be resolved?
The dispute mechanism should match the project's scale and financing. For major works, a tiered structure — engineer's determination, dispute board, then arbitration — keeps disputes moving without stopping the works.
